Andrea Cermele is a lawyer for various public bodies and private companies operating in the public procurement sector for works, services and supplies, and mainly deals with tender procedures and related litigation. He has developed specific expertise in project financing and more generally in partnership procedures, both public and private. He also advises major multi-utility and in-house companies in the field of contracts and concessions.
He assists as well contracting authorities and economic operators in judicial litigation.
Andrea has been enrolled in the Bar since 2008.
Andrea began his activity as an internal legal consultant for a company operating in the public service procurement sector and in 2009 began collaborating with Merani, becoming a partner in 2013.
He collaborates on a regular basis with the tender offices of contracting authorities and deals with the drafting and/or revision of tender documents (calls for tenders, tender documents, application forms, tender minutes, exclusion measures and admission), participation in meetings and sessions of the evaluation comitte, as well as more generally drafting opinions on the subject of public contract law. He also provides assistance to the tender offices of private companies who participate in public tender procedures and mainly deals with the preparation of administrative documentation to be presented in the tender, temporary association contracts of companies, reliance contracts and subcontracts, explanations for the abnormally low tenders.
In recent years Andrea has developed significant experience in project financing procedures, dedicating himself to assisting entities and economic operators in the presentation and/or juridical-administrative evaluation phase of public-private partnership proposals, formulated above all for the management of networks of public lighting and for the energy efficiency of public/private buildings.
He has been authorized to practice before Hight Court since 2021 (Cassazione and Consiglio di Stato) and regularly assists in appeals to the Regional Administrative Court relating to tenders, in which he has gained significant experience over time. He also has experience in sanction proceedings before the A.N.A.C. (National Anti-Corruption Authority).
He has spoken at numerous conferences on the Code of Public Contracts and holds training courses on public tender procedures. He was also recently co-author of the comment on art. 95 of Legislative Decree. 50/16 of the Code of Contracts, Wolters Kluwer, ed. 2021 with Antonella Borsero (forthcoming).
He has a good knowledge of French and English.
